What this bill would do
The Fair Access to Banking Act aims to stop certain large financial institutions and payment card networks from denying financial services to lawful businesses based on subjective political reasons, bias, or reputational risks. The bill requires covered banks and institutions to make their financial services available on proportionally equal terms and to use quantitative, impartial risk-based standards when deciding whether to serve a customer. If a covered bank denies a person a financial service, it must provide a written justification that cannot be based solely on reputational risk. The legislation imposes penalties, such as restricting access to taxpayer-funded discount window lending programs and the Automated Clearing House Network, for banks that refuse to do business with lawful persons. Additionally, it gives affected individuals the right to sue violating banks in a United States district court for treble damages and attorney fees.

Potential Positive Impacts for People
-
Access to Financial Services for Lawful Businesses: Section 8(b)(1)(A) requires covered banks to make their offered financial services available to all persons in their geographic market on proportionally equal terms, which ensures that individuals and groups engaged in lawful activities cannot be shut out of the financial system simply because of a prejudice or dislike for their business or products.
-
Protection Against Category-Based Denials: Section 8(b)(1)(B) ensures that financial service denials cannot happen unless justified by a documented failure to meet quantitative, impartial risk-based standards established in advance, protecting individuals from arbitrary treatment by large institutions.
-
Right to Written Explanations: Section 8(b)(1)(D) requires banks to provide a written justification explaining the basis for any service denial, which gives individuals accountability and clear information regarding why an institution made its decision.
-
Legal Recourse and Compensation: Section 8(c) allows people who suffer harm from a bank violating these fair access rules to immediately file a civil action in a U.S. district court without exhausting administrative remedies, and rewards prevailing plaintiffs with reasonable attorney fees and treble damages.
Potential Negative Impacts for People
-
Compliance Burdens and Increased Operational Costs: Section 8 sets up extensive rules, documentation requirements, and written justification mandates for covered banks, which could increase operational expenses that banks might ultimately pass down to everyday consumers through higher fees or reduced services.
-
Litigation Risks for Financial Institutions: Section 8(c) exposes covered banks to civil lawsuits, treble damages, and attorney fees for denying services, which could create a litigious environment where institutions are forced to maintain risky customer relationships out of fear of being sued rather than relying on sound business judgment.
