What this bill would do
This bill is called the Ensuring Justice for Camp Lejeune Victims Act of 2025. It makes changes to the Camp Lejeune Justice Act of 2022. The bill removes the rule that restricted lawsuits to only the United States District Court for the Eastern District of North Carolina. It updates the burdens and standards of proof required for individuals filing an action. It establishes exclusive jurisdiction and venue rules, allows for action transfers, and provides for jury trials and expedited disposition. Finally, the bill sets limits on attorney fees and takes effect as if it was enacted on August 10, 2022.

Potential Positive Impacts for People
-
Section 2(2) amends subsection (c) to state that a filing party is entitled to appropriate relief upon showing a relationship between water contaminants at Camp Lejeune and their harm, and that they were present for at least 30 days. This could make it clearer for individuals to prove their claims.
-
Section 2(3) amends subsection (d)(2) to allow a party filing an action to transfer it to the Eastern, Middle, or Western Districts of North Carolina or the District of South Carolina for pretrial and trial. This gives individuals more location options for their cases.
-
Section 2(3) amends subsection (d)(3) to allow any action against the United States to be tried by the court with a jury at the request of either party. This provides individuals with the option of a jury trial.
-
Section 2(3) amends subsection (d)(4) to require the court to advance an action on the docket and expedite its disposition to the greatest extent possible. This helps individuals get faster resolutions for their cases.
-
Section 2(4) adds subsection (k), which caps total attorney fees at not more than 20 percent of a settlement before a civil action is commenced, or 25 percent after a civil action is commenced. This protects individuals by ensuring they keep a larger share of their settlements or judgments.
