What this bill would do
This bill is titled the Supreme Court Tenure Establishment and Retirement Modernization Act of 2025. It changes how long Supreme Court justices can serve in active service by setting an 18-year term limit for new justices. Under the bill, the President will appoint one new justice during the first and third years following a presidential election year. It also requires the Senate to vote on these nominations within specific time limits, such as 90 days for initial nominations. Finally, current justices will retire from active service in order of their length of service as new justices are appointed under this system.

Potential Positive Impacts for People
-
Clear Appointment Schedule: Under Section 2 (adding new section 7(a)), the President is required to appoint one justice during the first and third years after a presidential election year. This creates a predictable and regular schedule for appointing Supreme Court justices.
-
Term Limits: Under Section 2 (adding new section 7(c)), individuals can only serve one 18-year term as a Supreme Court Justice. This ensures that no single justice stays in regular active service indefinitely.
-
Senate Decision Deadlines: Under Section 2 (adding new section 7(d)), the Senate must vote on a nomination within 90 days, or within 120 days for a subsequent nomination if the first is withdrawn or disapproved. This prevents nominations from sitting indefinitely without action.
Potential Negative Impacts for People
- Mandatory Retirement for Current Justices: Under Section 2 (adding new section 8(b)), current justices appointed before the enactment of the bill are deemed to have retired from regular active service as new justices are appointed, starting with the justice who has served the longest. This forces sitting justices out of active service based on the new appointment schedule.
