What this bill would do
This bill is cited as Goldie's Act and aims to increase enforcement of the Animal Welfare Act. It clearly defines what a violation is and requires the Secretary to make inspections and investigations of facilities at least once each year. The legislation directs inspectors to promptly confiscate or destroy in a humane manner any animal found suffering physical or psychological harm due to a failure to comply with the rules. It also requires the Secretary to share violation records with State, local, and municipal animal control or law enforcement officials within 24 hours. Additionally, the bill updates civil penalties, fines, and hearing requirements for violators.

Who it would affect, and how
Potential Positive Impacts for People
-
Section 2(b) requires the Secretary to inspect each research facility and the premises of each dealer and exhibitor at least once each year, and conduct follow-up inspections until all violations are corrected. This ensures consistent oversight of regulated entities.
-
Section 2(c) mandates that the Secretary provide a copy of all records documenting any violation to State, local, and municipal animal control or law enforcement officials within 24 hours of an inspection. This keeps local authorities promptly informed of issues in their jurisdictions.
-
Section 2(d) increases civil penalties to not more than $10,000 for each violation and requires penalties to be calculated on a per animal and per violation basis without being reduced by 10 percent or more. This creates a stronger financial deterrent against mistreatment.
Potential Negative Impacts for People
-
Section 2(b) requires inspectors to confiscate or destroy in a humane manner any animal found suffering physical or psychological harm, and prohibits dealers, exhibitors, and others from destroying any other animal in their possession without written consent once notified. This places strict restrictions and operational burdens on facility owners.
-
Section 2(d) establishes that each violation and each day during which a violation continues shall be a separate offense, and imposes civil penalties up to $10,000 per violation alongside potential cease and desist order penalties. This could result in heavy financial burdens for businesses found in noncompliance.
