What this bill would do
This bill, known as the "Freight RAILCAR Act of 2025," aims to amend the Internal Revenue Code of 1986. It establishes a new tax credit intended to encourage the replacement or modernization of inefficient and outdated freight railcars. The credit is set at 10 percent of a taxpayer's freight railcar fleet modernization expenses. To prevent excessive use, the credit is limited to 1,000 qualified freight railcars per taxpayer per taxable year. The program is scheduled to expire three years after the Act's enactment.

Potential Positive Impacts for People
-
Financial incentive for modernization: Taxpayers can receive a credit equal to 10 percent of their freight railcar fleet modernization expenses, which may encourage the upgrading of equipment (Section 2(a)).
-
Improved railcar capacity and fuel efficiency: The bill targets "significant improvements," which include increasing the capacity or fuel efficiency of a railcar by at least 8 percent (Section 2(a)(4)(B)).
-
Enhanced safety standards: The credit applies to modernized railcars that meet specific performance requirements, such as the Association of American Railroads Standard S-286 or design standards set by the Pipeline and Hazardous Materials Safety Administration (Section 2(a)(4)(B)).
Potential Negative Impacts for People
-
Limits on the amount of credit: There is a cap of 1,000 qualified freight railcars per taxpayer per year, which limits the total scope of the incentive for large entities (Section 2(a)(b)).
-
Restrictions on eligible entities: Taxpayers that would be ineligible for a contract or subcontract under 49 U.S.C. 5323(u) are prohibited from receiving the credit (Section 2(a)(6) and Section 2(a)(5)).
-
Temporary nature of the credit: The incentive is not permanent, as the credit expires three years after the date of the Act's enactment (Section 2(a)(e)).
