What this amendment would do
The amendment, titled the Nationwide Consumer and Fuel Retailer Choice Act of 2025, aims to add a new section to bill S. 2296. Its purpose is to change specific rules regarding fuel and ethanol within the Clean Air Act.
The amendment seeks to add or change the following:
-
Ethanol Waivers: It updates how the Administrator handles waivers for fuels or fuel additives. It specifies that a fuel or fuel additive may be introduced into commerce if the Administrator determines it is substantially similar to one used in vehicle certification, or if it has a waiver and meets all conditions except for the Reid Vapor Pressure limitation.
-
Reid Vapor Pressure: It amends the Clean Air Act to change certain percentages from 10 percent to 10 to 15 percent. It also addresses how these limitations apply to states based on when notifications were submitted relative to the enactment of this Act.
-
Small Refinery Credits: It adds rules for small refineries to handle credits generated for the 2016-2018 compliance years. These credits can be returned to the small refinery for future use or applied to their EPA Moderated Transaction System (EMTS) account, depending on when petitions were submitted and their status as of specific dates in 2019 and 2022.
