What this bill would do
The "Disarm Hate Act" aims to prevent individuals from obtaining firearms if they have been convicted of a misdemeanor hate crime or received an enhanced sentence for a misdemeanor due to hate or bias. It defines a misdemeanor hate crime as an offense involving physical force, threatened use of a deadly weapon, or other credible threats motivated by hate or bias regarding race, color, religion, national origin, gender, sexual orientation, gender identity, or disability. The bill amends existing federal law to prohibit the sale, disposition, possession, shipment, or transport of firearms for such individuals. Certain exceptions apply if the person had legal counsel, a jury trial, or had their conviction expunged or pardoned.
