What this bill would do
The "Disarm Hate Act" aims to prevent individuals from obtaining firearms if they have been convicted of a misdemeanor hate crime or received an enhanced sentence for a misdemeanor due to hate or bias. It defines a misdemeanor hate crime as an offense involving physical force, a deadly weapon threat, or a credible threat to physical safety motivated by hate or bias regarding race, color, religion, national origin, gender, sexual orientation, gender identity, or disability. The law also applies to those receiving enhanced sentences based on judicial findings of hate-motivated conduct. These prohibitions apply across Federal, State, and Tribal laws. The Act amends existing federal laws regarding the sale, shipment, and possession of firearms.
