What this bill would do
The "Unclaimed Retirement Rescue Plan" directs the Secretary of Labor to create a regulation that allows pension plan administrators to voluntarily move unclaimed retirement funds to State unclaimed property programs. Before transferring funds of $50 or more, administrators must try to find the person's current contact information and send a notice. The bill establishes a reporting system for these transfers and integrates the data into the Retirement Savings Lost and Found Database. It also provides legal relief to fiduciaries who follow these rules.

Potential Positive Impacts for People
-
Recovery of Forgotten Funds: By allowing transfers to State unclaimed property programs through a national clearinghouse, individuals can potentially recover forgotten retirement distributions (Section 2(b)).
-
Improved Search Efforts: For distributions of $50 or more, the bill requires administrators to search informational databases and commercially reasonable outside sources to find a participant's current address or contact info (Section 2(c)(1)(A)).
-
Advance Notification: Participants or beneficiaries are entitled to a notice explaining that their funds are held and providing instructions on how to prevent the transfer to a State program (Section 2(c)(1)(B)).
-
Centralized Tracking: The Secretary of Labor must include information about transferred distributions in the Retirement Savings Lost and Found Database to help people find their money (Section 2(f)(3)(A)).
Potential Negative Impacts for People
-
Limited Notice Requirements: The requirement to send a notice to the participant is waived if the administrator's search for updated contact information does not yield any results (Section 2(c)(3)).
-
Amount Restrictions: For plans not undergoing termination, only single unpaid obligations that do not exceed $5,000 are covered under the standard definition of an unclaimed retirement distribution, unless the Secretary of Labor chooses to increase that limit (Section 2(j)(6)(A)(ii)).
