What this bill would do
This bill stops people and businesses from using certain computer and artificial intelligence systems to set customized prices and wages based on surveillance data. It sets rules for exceptions like standard discounts for veterans, students, or loyalty programs, provided those rules are clear and public. The Federal Trade Commission and state officials are given the power to enforce these rules. Consumers and workers also get the right to sue companies directly if they are hurt by these practices. Furthermore, the bill preserves collective bargaining rights and allows states to enforce stricter laws.

Who it would affect, and how
Potential Positive Impacts for People
-
Protection from Surveillance-Based Pricing: Under Section 2(a), the bill generally bans surveillance-based price setting, which helps protect consumers from having automated systems use their personal data, behavior, or biometrics to customize prices against them.
-
Right to Sue and Recover Damages: Under Section 2(d) and Section 3(f), consumers and workers who are injured by violations can bring a civil action in court to obtain actual monetary damages or $3,000 per violation, whichever is greater, along with reasonable attorney's fees.
-
Fair Wage Protections: Under Section 3(a), the bill prohibits surveillance-based wage setting using personal information or surveillance data, ensuring that automated systems cannot unfairly manipulate worker pay based on invasive data tracking.
-
Transparency and Data Correction: Under Section 2(a)(3) and Section 3(b), companies must publish procedures at least 180 days in advance that allow consumers and workers to correct or challenge the accuracy of data considered by automated decision systems.
-
Preservation of Collective Bargaining: Under Section 5, the bill ensures that employee rights to collectively bargain over terms of employment and negotiate stronger protections against surveillance-based wage discrimination are fully preserved.
Potential Negative Impacts for People
-
Burdens on Loyalty and Rewards Programs: Under Section 2(a)(1)(C) and Section 2(a)(2), consumers must affirmatively enroll in programs and companies must meet strict uniform offering and disclosure conditions to provide discounted prices, which could potentially reduce the ease or availability of certain quick store promotions.
-
Mandatory Public Disclosures for Businesses: Under Section 2(a)(3) and Section 3(b), any person intending to use an automated decision system must publish detailed procedures and data-collection methods 180 days in advance, which could create administrative hurdles or compliance costs that might indirectly affect smaller organizations or everyday operations.
