What this amendment would do
SA 5365, submitted by Mr. Padilla, aims to add a section to title III of S. Con. Res. 33.
The purpose of this amendment is to create a deficit-neutral reserve fund. This would allow the Chairman of the Committee on the Budget of the Senate to adjust budget allocations and the pay-as-you-go ledger for measures reported by the Committee on the Judiciary of the Senate regarding claims against the United States.
Specifically, this may include:
- Prohibiting the United States Department of Justice from making financial settlements with people convicted for the attack on the United States Capitol on January 6, 2021.
- Including individuals who had their sentences commuted or were pardoned.
This is provided that the legislation does not increase the deficit between fiscal years 2026 and 2035.
