What this amendment would do

SA 5364, submitted by Mr. Padilla, aims to add a section to title III of S. Con. Res. 33.

The purpose of this amendment is to create a deficit-neutral reserve fund to ensure the delivery of absentee ballots and mail.

It would allow the Chairman of the Senate Committee on the Budget to:

  • Adjust committee allocations, aggregates, and other levels in the resolution.
  • Make adjustments to the pay-as-you-go ledger for specific legislative actions relating to the delivery of mail and absentee ballots.

This may include stopping the United States Postal Service from starting a rulemaking process that would allow the failure to deliver certain absentee ballots and mail under Executive Order 14399.

The amendment specifies that these actions are allowed as long as the legislation does not increase the deficit from fiscal year 2026 through 2035.
