What this amendment would do

SA 5350, submitted by Mr. Husted, aims to add a new section (SEC. 3003) to title III of the concurrent resolution S. Con. Res. 33.

The purpose of this amendment is to create a deficit-neutral reserve fund. This allows the Chairman of the Senate Committee on the Budget to adjust budget allocations and the pay-as-you-go ledger for legislation, amendments, or conference reports from the Committee on the Judiciary or the Committee on Homeland Security and Governmental Affairs regarding immigration enforcement.

Specifically, this may include funding for U.S. Immigration and Customs Enforcement personnel to handle the following for adult illegal aliens who entered the U.S. illegally and were convicted of murder:

  • Apprehension
  • Mandatory detention
  • Expedited deportation

This is allowed as long as the legislation does not increase the deficit between fiscal years 2026 and 2035.
