What this amendment would do

SA 5180, submitted by Mr. Kaine, aims to add a section to title IV of S. Con. Res. 33. The purpose is to create a point of order against funding certain activities regarding worker medical data.

Specifically, it seeks to stop the Senate from considering any motion, bill, amendment, or report that funds:

  • The collection or publication of health and medical records of individuals in health benefits plans under chapter 89 of title 5, United States Code. This includes the Postal Service Health Benefits Program and the Federal Employees Health Benefits Program.
  • The communication of these records to any Federal agency or the Office of Personnel Management.

The amendment also states that this point of order can only be waived, suspended, or appealed with an affirmative vote of three-fifths of the Members of the Senate.
