What this amendment would do

SA 5173, submitted by Mr. Kaine, aims to add a new section to the concurrent resolution S. Con. Res. 33.

The purpose of this amendment is to create a deficit-neutral reserve fund regarding the prohibition of arbitrary arrest quotas for U.S. Border Patrol and U.S. Immigration and Customs Enforcement.

Specifically, it allows the Chairman of the Senate Committee on the Budget to:

  • Revise committee allocations, aggregates, and other levels in the resolution.
  • Make adjustments to the pay-as-you-go ledger for legislation relating to immigration enforcement quotas.

This is permitted as long as the legislation does not increase the deficit from fiscal year 2026 through 2035.
