What this amendment would do

SA 5172, submitted by Mr. Kaine, aims to add a section to the budget resolution known as the Deficit-Neutral Reserve Fund.

The purpose of this amendment is to allow the Chairman of the Senate Committee on the Budget to adjust budget allocations and the pay-as-you-go ledger for legislation concerning searches conducted by U.S. Border Patrol and U.S. Immigration and Customs Enforcement officers and agents.

Specifically, it focuses on legislation that may:

  • Prohibit these officers and agents from entering private homes without a warrant issued by a Federal judge.

This change is permitted as long as the legislation does not increase the deficit from fiscal year 2026 through 2035.
