What this amendment would do
SA 5171, submitted by Mr. Kaine, aims to add a section to title IV of S. Con. Res. 33. The purpose is to create a point of order against increasing the deficit through reconciliation multiple times during a single Congress.
-
The amendment would make it out of order in the Senate to consider a reconciliation bill, amendment, or conference report that increases a deficit or reduces a surplus in any year if the Congressional Budget Office estimated that a previous reconciliation bill enacted during the same Congress also increased a deficit or reduced a surplus.
-
This rule can be waived or suspended, or an appeal of the Chair's ruling can be sustained, only by an affirmative vote of three-fifths of the Members of the Senate.
-
The Congressional Budget Office, via the Committee on the Budget of the Senate, would provide the estimates used to determine the net deficit increases and net surplus reduction.
