What this amendment would do
SA 5170, submitted by Mr. Kaine, aims to add a new section (SEC. 3003) to title III of S. Con. Res. 33.
The purpose of this amendment is to create a deficit-neutral reserve fund to address racial profiling by U.S. Border Patrol and U.S. Immigration and Customs Enforcement agents and officers.
Specifically, the amendment allows the Chairman of the Senate Committee on the Budget to adjust budget levels and the pay-as-you-go ledger for legislation that focuses on preventing racial profiling. This includes preventing the following actions based solely on appearance, language, ethnicity, or perceived race:
- Stopping
- Interrogating
- Arresting
- Detaining
This is permitted as long as the legislation does not increase the deficit between fiscal years 2026 and 2035.
