What this amendment would do

SA 5165, submitted by Mr. Kaine, aims to add a section to title III of S. Con. Res. 33.

The purpose of this amendment is to create a deficit-neutral reserve fund for automatic tariff refunds.

  • It allows the Chairman of the Senate Committee on the Budget to adjust budgetary levels and the pay-as-you-go ledger for legislation related to providing automatic refunds for tariffs that the Supreme Court holds to be illegal.

  • This is permitted as long as the legislation does not increase the deficit for the total of fiscal years 2026 through 2035.
