What this amendment would do

SA 5144, submitted by Mr. Padilla, aims to add a section to title III of S. Con. Res. 33.

The purpose of this amendment is to create a deficit-neutral reserve fund to protect pregnant, postpartum, and lactating women and their infants.

It allows the Chairman of the Committee on the Budget of the Senate to adjust budget allocations and the pay-as-you-go ledger for legislation related to these protections. Specifically, this may include:

  • Prohibiting the use of electronic or physical restraints on these women.
  • Prohibiting the detention of these women for more than 72 hours, unless they are determined to be a serious flight risk.

This is provided that the legislation does not increase the deficit between fiscal years 2026 and 2035.
