What this amendment would do
SA 5142, submitted by Mr. PADILLA, is an amendment to S. Con. Res. 33. This resolution sets the congressional budget for fiscal year 2026 and budgetary levels for fiscal years 2027 through 2035.
The purpose of this amendment is to create a deficit-neutral reserve fund focused on prohibiting racial or ethnic profiling in immigration enforcement.
It aims to add a section to title III that allows the Chairman of the Committee on the Budget of the Senate to:
- Revise committee allocations, aggregates, and other levels in the resolution.
- Make adjustments to the pay-as-you-go ledger.
These actions apply to legislation relating to prohibiting immigration enforcement actions where the following are used as the sole basis to form a reasonable suspicion to stop, arrest, or detain an individual:
- Race
- Ethnicity
- Nationality
- English proficiency
- Any other perceived or actual protected characteristic
This is permitted as long as the legislation does not increase the deficit from fiscal years 2026 through 2035.
