What this amendment would do

SA 4861, submitted by Mr. Padilla, aims to add a section to title III of S. Con. Res. 33.

The purpose is to create a deficit-neutral reserve fund focused on preventing avoidable deaths in U.S. Immigrations and Customs Enforcement custody.

This amendment would allow the Chairman of the Senate Committee on the Budget to adjust budget allocations, aggregates, and the pay-as-you-go ledger for legislation that addresses the following:

  • Preventing avoidable deaths in U.S. Immigrations and Customs Enforcement custody.
  • Ensuring access to timely and adequate healthcare.
  • Making data and information regarding medical resources at detention facilities accessible to Congress.

This is permitted as long as the legislation does not increase the deficit from fiscal year 2026 through 2035.
