What this amendment would do

SA 4860, submitted by Mr. Padilla, aims to add a section to title III of S. Con. Res. 33. The purpose is to create a deficit-neutral reserve fund to preserve the rights of state and local governments to oversee U.S. Customs and Border Protection and U.S. Immigrations and Customs Enforcement.

This amendment would allow the Senate Budget Committee Chairman to adjust budgetary levels and the pay-as-you-go ledger for legislation that focuses on:

  • Preserving the ability of state and local jurisdictions to prosecute potential crimes and use-of-excessive-force incidents.
  • Requiring that evidence be shared and preserved for these jurisdictions.
  • Requiring prior consent from these jurisdictions for large-scale operations that are not targeted immigration enforcement.

The amendment specifies that this applies as long as the legislation does not increase the deficit between fiscal years 2026 and 2035.
