What this amendment would do

SA 4859, submitted by Mr. Padilla, is an amendment to S. Con. Res. 33. This resolution sets the congressional budget for fiscal year 2026 and the budgetary levels for fiscal years 2027 through 2035.

The purpose of this amendment is to create a deficit-neutral reserve fund focused on protecting human dignity and civil liberties. It allows the Chairman of the Senate Committee on the Budget to adjust budgetary levels and the pay-as-you-go ledger for legislation that aims to:

  • Ensure basic detention standards across detention facilities.
  • Prevent the arrest or detention of United States citizens.
  • Require an individual to have immediate access to their attorney.
  • Allow States to sue the Department of Homeland Security for violating these requirements.

This is permitted as long as the legislation does not increase the deficit between fiscal years 2026 and 2035.
