What this amendment would do

SA 4849 is an amendment proposed by Mrs. Shaheen and other members to be added to the concurrent resolution S. Con. Res. 33.

The purpose of this amendment is to create a deficit-neutral reserve fund to handle legislation that limits the creation of new U.S. Immigration and Customs Enforcement (ICE) processing or detention facilities unless state and local consent is given.

This amendment aims to add a section to the bill that allows the Chairman of the Senate Committee on the Budget to adjust budget allocations and the pay-as-you-go ledger for legislation that may include:

  • Requiring a signed written agreement with the Governor of the State and local government officials.
  • Initiating a public comment period.
  • Issuing advanced notification to Congress.

These adjustments are permitted as long as the legislation does not increase the deficit for the periods of fiscal years 2026 through 2030 or 2026 through 2035.
