What this amendment would do

This amendment aims to change the bill by striking section 111 and inserting new requirements for voters to provide photo identification when voting in Federal elections.

The purpose of this amendment is to add the following requirements:

  • In-Person Voting: Voters must present a valid physical photo identification to receive a ballot. Those without one may cast a provisional ballot, but must provide the required identification or a religious objection affidavit within 3 days for their eligibility to be determined.

  • Voting Other Than In Person: Voters must submit a copy of a valid photo identification. Alternatively, they may provide the last four digits of their Social Security number and an affidavit stating they are unable to obtain photo identification after making reasonable efforts. This does not apply to absent uniformed services voters or certain individuals provided the right to vote other than in person under the Voting Accessibility for the Elderly and Handicapped Act.

  • Accepted Identification: Valid photo identification includes:

    • State-issued motor vehicle driver's licenses with a photo and expiration date.
    • State-issued identification cards from a motor vehicle authority with a photo and expiration date.
    • United States passports.
    • Military identification (issued by the Department of Defense or Department of Veterans Affairs).
    • Tribal government identification with a photo and expiration date.
  • State Obligations: States must notify individuals of these requirements during the voter registration process, including online registrations. Additionally, states must provide free public access to digital imaging devices (like scanners or copiers) at government buildings, such as libraries, police stations, and courts, so people can copy their identification.
