What this amendment would do

The FIGHT China Act of 2025 (Foreign Investment Guardrails to Help Thwart China Act of 2025) is an amendment to bill S. 2296. Its purpose is to protect national security by restricting United States persons from investing in certain technologies and entities linked to the People's Republic of China, including Hong Kong and Macau.

The amendment aims to add the following to the bill:

  • Sanctions Power: It allows the President to impose sanctions on covered foreign persons who knowingly operate in the surveillance technology or defense and related materiel sectors of a country of concern.

  • Investment Restrictions: It amends the Defense Production Act of 1950 to let the Secretary of the Treasury prohibit U.S. persons from engaging in covered national security transactions involving prohibited technology (such as advanced semiconductors, AI models, and quantum computing). It also requires notification for transactions involving notifiable technology.

  • Securities Prohibitions: It requires the President to create rules prohibiting U.S. persons from knowingly holding securities of entities on the Non-SDN Chinese Military-Industrial Complex Companies List.

  • Funding and Oversight: It authorizes $150,000,000 for the Department of the Treasury and provides for hiring authority to carry out these tasks. It also mandates regular reports to Congress regarding enforcement actions and national security threats.

  • Public Database: It allows for the creation of a public database of covered foreign persons involved in prohibited technology.
