What this amendment would do

SA 3880 is an amendment proposed by Ms. Collins and Ms. Duckworth to be added to the bill S. 2296. Its purpose is to require the Secretary of Defense to provide a report on the United States boot industrial base and how to follow the Berry Amendment.

The amendment aims to add Section 849B to the bill, which requires a report to be submitted to congressional defense committees within 90 days of the Act's enactment. This report must include a plan to fully comply with the Berry Amendment by fiscal year 2028.

The report must include the following:

  • A description of current and surge manufacturing capacity for Berry-compliant boots, including risks to the supply chain and small business participation.
  • A survey of domestic boot manufacturers to see if they are interested in producing Berry-compliant boots if all Armed Forces members were required to wear them.
  • A schedule of actions and resources needed to reach full compliance for combat footwear by fiscal year 2028.
  • An assessment of how "optional combat boots" that are not Berry-compliant weaken the U.S. industrial base and undermine the Berry Amendment.
  • A plan to manage medical and availability exemptions to prevent them from being overused.
  • Steps to grow industrial capacity using tools like multiyear contracting and requiring optional boots to be Berry-compliant.
