What this amendment would do
SA 3821, submitted by Mr. Padilla, aims to add a section to bill S. 2296 regarding Congressional oversight of domestic use of the reserve components of the Armed Forces.
The purpose of this amendment is to require the President to report to Congress within 15 days after deploying or using reserve components of the Armed Forces within the United States. This reporting requirement includes:
- The legal basis and goals for the deployment and supporting evidence.
- The effect of the deployment, including reports of interactions between Armed Forces members and civilians involved in violence or threats of violence.
- Reports from State and local law enforcement regarding those interactions and their assessment of the deployment.
- The total cost to the Federal Government, including indirect costs.
- A certification that the use of these forces will not hinder the ability to respond to disasters covered under the Robert T. Stafford Disaster Relief and Emergency Assistance Act.
Additionally, the amendment requires the Chief of the National Guard Bureau to brief Congress on whether the goals were met and if violence was reduced.
The amendment does not apply to deployments made under the Robert T. Stafford Disaster Relief and Emergency Assistance Act in response to weather-related events or natural disasters.
