What this amendment would do
SA 3810 aims to change the Defense Production Act of 1950 by adding new rules and prohibitions regarding foreign investment in United States agriculture.
The amendment adds the following to the bill:
-
Agricultural Review: It defines "agriculture" and requires the Committee on Foreign Investment in the United States to determine if "reportable agricultural land transactions" are covered transactions. This happens after receiving notification from the Secretary of Agriculture.
-
Committee Membership: It adds the Secretary of Agriculture to the committee for covered transactions involving agricultural land, agricultural biotechnology, or the agriculture industry.
-
Prohibitions: The President must prohibit transactions where a "covered foreign person" (someone acting for a government of a "covered country") would purchase or lease agricultural land near sensitive U.S. military installations or government facilities, or gain control of a U.S. business engaged in agriculture.
-
Covered Countries: The specific countries listed as potential foreign adversaries include:
- The People's Republic of China.
- The Russian Federation.
- The Islamic Republic of Iran.
- The Democratic People's Republic of Korea.
-
Waivers and Exceptions: The President can waive these prohibitions on a case-by-case basis if it is in the national interest. The rules do not apply to U.S. citizens or lawful permanent residents.
-
Administrative Requirements: It requires agencies on the committee to submit their most recent spending plans within 60 days of enactment and directs the President to issue regulations to carry out these changes.
