What this amendment would do
SA 3780, also known as the AUKUS Improvement Act of 2025, is an amendment intended for bill S. 2296. It aims to add a new subtitle to title XII of that bill.
The purpose of this amendment is to change and add the following:
-
Arms Export Flexibility: It amends the Arms Export Control Act to allow defense articles (not listed in Supplement No. 2 to Part 126 of title 22 of the Code of Federal Regulations) to be reexported, retransferred, or temporarily imported exclusively between the Government of Australia, the Government of the United Kingdom, or eligible entities. These transfers would not require consent from the President under section 3(a)(2) of the Act or section 505(a)(1) of the Foreign Assistance Act of 1961.
-
Transfer Authorizations: It authorizes intra-company, intra-organization, and intra-governmental transfers of defense articles and services between authorized officers, employees, and agents, including certain dual or third country nationals.
-
Elimination of Certification: It removes the requirement for congressional notification under section 36(d) of the Arms Export Control Act for Manufacturing Licensing Agreements and Technical Assistance Agreements involving Australia and the United Kingdom for defense articles subject to the section 38(l) licensing exemption.
