What this amendment would do
This amendment, known as the Mapping America's Pharmaceutical Supply Act or the MAPS Act, aims to add a new section to the bill to improve how the U.S. tracks its pharmaceutical supply chains.
The purpose of this amendment is to have the Secretary of Health and Human Services, along with other federal agencies and public-private partnerships, map and visualize the supply chains for drugs and biological products. This focus applies specifically to products that are:
- Directly related to responding to chemical, biological, radiological, or nuclear threats and incidents under the National Response Framework.
- Identified as high-risk for shortages and a high priority for health care.
The amendment adds requirements to identify supply chain vulnerabilities that threaten national security using data analytics. It also requires the Secretary to:
- Describe the roles of offices within the Department of Health and Human Services regarding supply chain monitoring.
- Facilitate information sharing between agencies, including data on the location of registered establishments, production amounts, and regulatory actions like recalls, seizures, and inspections.
The amendment mandates several reports to Congress:
- An annual report from the Secretary of Health and Human Services detailing the status of mapping efforts, the use of predictive modeling for shortages, and the extent of reliance on high-risk foreign suppliers or entities of concern (specifically those where more than 50 percent of production is sourced).
- A report every 180 days from the Secretary of Defense listing all drugs purchased that were manufactured in the People's Republic of China or contain ingredients sourced from there.
Finally, the amendment includes provisions to protect confidential commercial information and requires the Secretary to implement robust cybersecurity measures to protect the exchanged data.
