What this amendment would do

SA 3731, submitted by Mr. Thune, aims to add a section titled Tribal Trust Homeownership to bill S. 2296. The purpose of this amendment is to establish strict deadlines and procedures for the Bureau of Indian Affairs (BIA) when reviewing and processing mortgage packages and right-of-way documents on Indian land.

The amendment proposes the following changes and additions:

  • Processing Deadlines: It sets specific timelines for the BIA to act, such as a 10-day window for preliminary reviews and 20 to 30 days to approve or disapprove leasehold mortgages, land mortgages, or right-of-way documents.

  • Accountability and Notice: BIA offices must notify lenders when documents are received and provide written explanations if a mortgage is disapproved. If deadlines are missed, the BIA must notify the affected parties immediately.

  • Title Status Reports: It mandates timelines for completing first and subsequent certified title status reports and outlines how these reports must be delivered to lenders and relevant federal agencies.

  • System Access and Reporting: It grants read-only access to the Trust Asset and Accounting Management System (TAAMS) for Indian Tribes and relevant federal agencies. Additionally, it requires an annual report to Congress on BIA's performance regarding these deadlines and a GAO study on the cost and need for digitizing records.

  • Realty Ombudsman: It creates a new Realty Ombudsman position within the BIA to oversee deadline compliance, facilitate communication between agencies, and resolve complaints from lenders, Indian Tribes, and tribal members.
