What this amendment would do
SA 3651 aims to add a new section, SEC. 1265, to the bill. This section focuses on identifying and prohibiting the use of property that has been nationalized or expropriated by certain foreign governments.
The amendment intends to change the bill by adding the following:
-
Identification of Prohibited Property: It requires the Secretary of Homeland Security, with the agreement of the Secretary of the Treasury and the Secretary of State, to identify and list prohibited property. This includes ports, harbors, or marine terminals in a covered foreign trade partner (a country in the Western Hemisphere with a U.S. free trade agreement) where land owned or controlled by a United States person was seized, nationalized, or had contracts nullified on or after January 1, 2024.
-
Restrictions on Use: The President must prohibit any vessel that was loaded or held at a designated prohibited property from:
-
Making a port of call in the United States.
-
Releasing any goods into the United States.
-
Docking any passenger vessel in the United States.
-
Releasing any passengers from a passenger vessel into the United States.
-
Performing any servicing, maintenance, refueling, or repair work.
-
Emergency Exception: These prohibitions do not apply if a vessel or an individual on a vessel is experiencing an emergency.
