What this amendment would do

This amendment introduces Division B, known as the American Dream and Promise Act of 2025, to the bill. The stated purpose of this division is to create pathways to lawful permanent resident status for certain long-term residents who entered the United States as children, as well as for certain nationals designated for temporary protected status or deferred enforced departure.

The amendment aims to change or add several key components to the existing legal framework:

  • Establishes the Dream Act of 2025, allowing certain individuals who arrived in the U.S. as children to obtain conditional permanent resident status, provided they meet specific physical presence, age, background, and educational requirements.

  • Sets out the terms for removing the conditional basis of that permanent resident status after individuals fulfill additional criteria, such as higher education, military service, or earned income.

  • Establishes the American Promise Act of 2025, allowing certain foreign nationals with temporary protected status or deferred enforced departure to adjust their status to lawful permanent residents.

  • Repeals section 505 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996, thereby restoring the option for States to determine residency for higher education benefits.

  • Implements general provisions covering application processes, biometric and biographic data requirements, background checks, fee exemptions, confidentiality safeguards, and grant programs to assist eligible applicants.
