What this amendment would do

SA 3512 is an amendment submitted by Mr. Daines and Mr. Murphy to be added to bill S. 2296. The purpose of this amendment is to add a new section, SEC. 1230B, which provides the authority to terminate the application of the Jackson-Vanik Amendment (Section 402 of the Trade Act of 1974).

The amendment aims to change the law by adding the following:

  • Presidential Authority: The President can stop the application of subsections (a) and (b) of Section 402 for a country if the President determines the government of that country is no longer in violation of specific paragraphs in subsection (a) and submits a report to the appropriate congressional committees.

  • Restrictions: The President cannot terminate the application for countries that are:

    • Designated as a state sponsor of terrorism.
    • Subject to a United States embargo.

This termination cannot happen until the embargo or designation is revoked.

  • Definitions: It defines appropriate congressional committees as the Senate Committee on Finance and Committee on Foreign Relations, and the House Committee on Ways and Means and Committee on Foreign Affairs. It also defines state sponsor of terrorism based on determinations made by the Secretary of State under specific laws, including the Export Control Reform Act of 2018, the Foreign Assistance Act of 1961, and the Arms Export Control Act.
