What this amendment would do
SA 3509, submitted by Mr. Daines, aims to change the National Environmental Policy Act of 1969 by adding a new section.
The purpose of this amendment is to allow the Secretary of Defense to exempt certain actions from the Act's requirements if they relate to the following:
- The Sentinel program.
- The ground-based strategic deterrent program.
- Any successor similar program.
The Secretary of Defense can grant these exemptions if they determine the action is critical to national security or necessary for national defense, after conferring with the Secretary of Commerce and/or the Secretary of the Interior.
These exemptions are limited to a period specified by the Secretary of Defense and cannot last more than 2 years. The Secretary of Defense must notify the House and Senate Committees on Armed Services within 30 days of issuing an exemption. This notice can be classified if deemed necessary for national security.
