What this amendment would do
This amendment, submitted by Mr. Banks, aims to add a new section (SEC. 1067) to the bill. Its purpose is to create a reporting process for researchers who were funded by the Department of Defense and are working in areas of research subject to export controls.
The amendment focuses on tracking the activities of these researchers after they stop working at an institution of higher education, specifically when they deal with covered entities, which include the governments of covered nations or foreign entities of concern.
Key Requirements
The Under Secretary of Commerce for Industry and Security would establish a process that includes:
- Reporting obligations for both the researchers and the institutions of higher education regarding activities with covered entities after employment ends.
- Data and risk assessments from institutions identifying covered individuals and the nature of their research.
- Tracking and metrics, including annual data identifying instances where covered entities engage in covered research.
- Mitigation measures that institutions must describe to implement the new rules.
- Notification procedures for when an institution cannot provide reports because an individual refuses to provide information.
The Under Secretary is also required to issue revised guidance on research security and export control resources by September 30, 2026.
