What this amendment would do
SA 3393, submitted by Ms. Cortez Masto, aims to change the procurement requirements for Department of Defense contractors regarding disclosures of rare earth elements and strategic and critical materials.
The amendment adds the following to the bill:
-
Advanced Batteries: It expands disclosure requirements to include advanced batteries or advanced battery components. Contractors must identify the countries where:
- Covered minerals used in the battery or component were refined, processed, or reprocessed.
- Covered minerals were manufactured into the battery or component.
- The battery cell, module, and pack were manufactured and assembled.
-
Definitions: It defines covered minerals as cobalt, graphite, lithium, manganese, and nickel. It also defines strategic and critical materials based on section 3(a) of the Strategic and Critical Materials Stock Piling Act.
-
Technical Changes: It updates specific language in the existing law, changing "provides the system" to "provides the system as described in paragraph (1)" and replacing "a senior acquisition executive" with "a service acquisition executive."
