What this amendment would do
This amendment, submitted by Ms. Cortez Masto, Mr. Grassley, and Mr. Lujan, aims to add disclosure requirements to bill S. 2296. It focuses on the ownership, storage, and maintenance of information within a foreign adversary country.
The amendment would require any person who owns, controls, or distributes access to a covered service to clearly disclose the following to individuals using the service:
- If the service is owned, in whole or in part, by a foreign adversary country, an entity owned by a foreign adversary country, or a non-state-owned entity located in a foreign adversary country.
- If the information collected by the service is stored and maintained in a foreign adversary country.
- If a foreign adversary country or a foreign adversary country-owned entity has access to that information.
It makes it unlawful to knowingly disclose false information. The Federal Trade Commission is tasked with enforcing these requirements, treating violations as unfair or deceptive acts or practices.
