What this amendment would do
SA 3349, submitted by Ms. Collins, aims to add a new section (SEC. 533) to bill S. 2296. The purpose of this addition is to require the Secretary of Defense to create a policy ensuring the Armed Forces use and participate in state extreme risk protection order programs.
This amendment would require each branch of the Armed Forces to do the following:
-
Utilize state programs when a commanding officer determines a member is a covered individual. A covered individual is a member determined to be unfit to carry or possess a firearm due to making a serious, credible threat of violence against themselves, other people, members of the Armed Forces, or a military facility, or those described in section 922(g)(4) of title 18, United States Code.
-
Fully participate in judicial proceedings to impose, review, extend, modify, or terminate these orders for current or former members. This includes providing relevant evidence and material facts to judicial or law enforcement personnel, regardless of the Privacy Act of 1974 or HIPAA privacy regulations.
-
Follow guidelines established by the Secretary of Defense to ensure commanding officers and other relevant personnel know the requirements of this section and the applicable state programs.
