What this amendment would do
This amendment, submitted by Mr. Kelly, aims to change the Office of National Drug Control Policy Reauthorization Act of 1998. Its purpose is to increase reporting requirements, funding, and resources focused on fentanyl and fentanyl-related substances.
Reporting and Accountability
The amendment adds requirements for reports on:
-
The use of HIDTA funds to investigate and prosecute organizations and individuals trafficking in fentanyl or fentanyl-related substances.
-
The amounts of fentanyl or fentanyl-related substances seized by HIDTA-funded initiatives.
-
Law enforcement and predictive data regarding patterns and trends in fentanyl trafficking, transportation, and substance abuse.
-
Limitations that prevent a high intensity drug trafficking area from meeting its goals, along with recommendations to fix those limitations.
Funding and Resources
The amendment proposes the following financial and resource changes:
-
Allocates $333,000,000 for each fiscal year from 2025 through 2030.
-
Increases a specific funding amount from $10,000,000 to $14,224,000.
-
Allows funds to be used for assistance to Federal, State, local, and Tribal law enforcement for interdicting fentanyl and other substances.
-
Grants the Director authority to use funds for other purposes to improve fentanyl prevention, seizure, and interdiction.
Prosecutorial Support
The amendment directs the Attorney General to:
-
Provide sufficient investigative and prosecution resources, including the temporary reassignment of assistant United States attorneys from 2024 through 2030 to prioritize fentanyl trafficking cases.
-
Create a process within 180 days of enactment for the Director to request these temporary reassignments in consultation with HIDTA Executive Boards.
