What this amendment would do
This amendment, known as the Visible Identification Standards for Immigration-Based Law Enforcement Act of 2025 (or the VISIBLE Act), aims to add new identification requirements for immigration officers during public enforcement activities.
The purpose of the amendment is to ensure transparency and accountability in public immigration enforcement to maintain public trust and uphold constitutional governance.
Changes and Additions
The amendment adds the following requirements:
- Visible Identification: Covered immigration officers must wear identification during public enforcement functions. This includes the agency's full name or recognized initials, and the officer's last name or unique badge number.
- Display Standards: The agency name must be legible from at least 25 feet in both daylight and low-light conditions. Identification must be on the outermost garment and not blocked by gear or armor.
- Face Coverings: Officers cannot wear non-medical face coverings that hide their face or identification unless it is for hazardous environments or covert operations.
- Accountability: The Secretary of Homeland Security must ensure officers who do not comply face administrative discipline, such as suspensions or written reprimands.
- Reporting and Oversight:
- The Secretary of Homeland Security must provide an annual report to Congress and the Office for Civil Rights and Civil Liberties detailing the number of enforcement functions, instances of noncompliance, and disciplinary actions taken.
