What this amendment would do

This amendment aims to combat illicit xylazine by adding it to the Controlled Substances Act.

Purpose and Changes

  • Classification: It adds xylazine, including its salts and isomers, to Schedule III of the Controlled Substances Act.

  • Definitions: It defines an "ultimate user" for xylazine as a person who received the substance from a registered veterinarian or pharmacy and possesses it for animals they own or care for, or for authorized government animal-control and wildlife programs.

  • Operational Adjustments:

    • Manufacturers are not required to pay for security standard capital expenditures.
    • Labeling and distribution logistics requirements are delayed for 1 year.
    • Practitioner registration and recordkeeping requirements are delayed for 60 days.
    • The FDA and DEA must help speed up manufacturer applications.
  • Legal and Oversight Measures:

    • It updates the Arcos Tracking system to include xylazine.
    • The United States Sentencing Commission must review and potentially amend penalties for offenses involving xylazine.
    • The Attorney General must submit two reports to Congress: one within 18 months regarding the prevalence, origin, and diversion of illicit xylazine, and an update report within 4 years.
