What this amendment would do
SA 2938, submitted by Mr. Schatz, aims to add new requirements for content distributed to the public by the Department of Defense.
The amendment seeks to change the bill by adding the following rules:
-
The Secretary of Defense must ensure covered content does not have false designations of origin or misleading descriptions and representations of fact that could deceive or confuse people about affiliations or misrepresent the content's nature, qualities, or origin.
-
Any covered artificial intelligence-generated content must have a clear and conspicuous disclosure embedded in the content. This disclosure must identify that AI was used and meet accessibility standards under the Americans with Disabilities Act of 1990.
-
The amendment defines covered content as audio, video, or image content. It defines covered artificial intelligence-generated content as digital content created or modified by generative AI that materially changes the meaning and would lead a reasonable person to believe it was not AI-generated.
