What this amendment would do
This amendment, submitted by Mr. Schatz for bill S. 2296, aims to hold the Department of Defense Education Activity accountable for potential censorship that may violate the First Amendment rights of Armed Forces members and their families.
The amendment adds a requirement for the Under Secretary of Defense for Personnel and Readiness to provide a report to congressional defense committees within 90 days of the Act's enactment. This report must detail the materials, programs, and activities restricted by memoranda issued on February 5, 2025, at covered schools.
Specifically, the report must include lists of the following items restricted at covered schools due to those memoranda:
- Books
- Modified curriculum materials or educational guidance
- Programs
- Activities
- Holidays or commemorative heritage activities
Additionally, the report must describe the process for administrators, teachers, parents, students, and other interested parties to submit complaints to the Director of the Department of Defense Education Activity, including an option for those submitting complaints to remain anonymous.
