What this amendment would do
Mr. Kaine submitted amendment SA 1894 to the concurrent resolution H. Con. Res. 14. The purpose of this amendment is to add a point of order against imposing tariffs on United States allies under emergency authorities.
Specifically, it aims to make it out of order in the Senate to consider any bill, joint resolution, motion, amendment, amendment between the Houses, or conference report that would impose, authorize the imposition of, or enable the collection of tariffs on imports from Canada or Mexico pursuant to emergency authorities—including the International Emergency Economic Powers Act—that would raise costs on United States consumers, farmers, and businesses.
Rules for Waiving the Rule
The amendment also sets rules for how this point of order can be bypassed. It states that this rule may be waived or suspended in the Senate only by an affirmative vote of three-fifths of the Members, duly chosen and sworn. Furthermore, an affirmative vote of three-fifths of the Members of the Senate, duly chosen and sworn, is required to sustain an appeal of the ruling of the Chair on a point of order raised under this section.
