What this amendment would do
Mr. Kaine submitted this amendment for the concurrent resolution establishing the congressional budget for the United States Government for fiscal year 2025 and setting forth appropriate budgetary levels for fiscal years 2026 through 2034. It aims to hold officials accountable by establishing a point of order in the Senate against considering certain legislation unless specific transparency rules regarding health insurance coverage are met.
What It Changes or Adds to the Bill
- It creates a rule that it shall not be in order in the Senate to consider legislation that affects Medicare, Medicaid, the Children's Health Insurance Program, provisions of the Affordable Care Act, or other health insurance laws for at least 1,000,000 people.
- It requires that the Congressional Budget Office has made the required estimate available on its website during the 72-hour period ending on the vote on final passage of the legislation.
- It sets a requirement that this rule can only be waived or suspended in the Senate by an affirmative vote of three-fifths of the Members, duly chosen and sworn.
- It requires an affirmative vote of three-fifths of the Members of the Senate to sustain an appeal of the ruling of the Chair on a point of order raised under this section.
- It mandates that during the 119th Congress, estimates provided by the Congressional Budget Office or the Joint Committee on Taxation for significant legislation shall, to the greatest extent practicable, include an estimate on the impact to health insurance coverage in the United States.
