What this amendment would do

MR. KAINE submitted amendment numbered SA 1778, which targets the way federal workers are classified.

  • The purpose of the amendment is to create a point of order in the Senate against funding any effort at a federal agency or department to politicize the competitive service.
  • It aims to stop bills, resolutions, motions, amendments, or conference reports from being considered in the Senate if they contain funding to reclassify competitive service federal employees into any schedule of excepted positions created after September 30, 2020, without the consent of Congress.
  • It sets a rule that this point of order can only be waived or suspended, and a ruling of the Chair can only be sustained upon appeal, by an affirmative vote of three-fifths of the Senators duly chosen and sworn.
