What this bill would do
This bill, titled the ``Rural Homeownership Continuity Act of 2025,'' proposes to amend the Housing Act of 1949. It specifically seeks to allow the assumption of loans within the Doug Bereuter Section 502 Single Family Housing Loan Guarantee Program. Under this change, qualified individuals could take over an existing guaranteed loan when property is transferred to them. Additionally, the bill provides for the release of the original borrower and any co-borrowers or guarantors from liability once the loan is assumed. The Secretary of Agriculture would also have the authority to allow loan servicers to charge fees for transaction costs.

Potential Positive Impacts for People
-
Loan Assumption by Qualified Individuals: The Secretary may allow a qualified individual to assume a current guaranteed loan when property is transferred to them (Section 2(a)(10)(A)). This provides a mechanism for continuing a loan through property transfers.
-
Release from Liability: When a property is transferred to an individual who assumes the loan, the original borrower, as well as any co-borrower or guarantor, is relieved of liability for that loan (Section 2(a)(10)(B)). This protects the original owner from future financial responsibility for the debt.
-
Transfer of Interests: The Secretary will ensure that the person assuming the loan takes on the obligations, rights, and interests of the loan (Section 2(a)(10)(C)).
Potential Negative Impacts for People
- Transaction Costs: The Secretary of Agriculture may issue a rule that allows loan servicers to charge borrowers fees for transaction costs associated with the loan (Section 2(c)). This could result in additional costs for people involved in these loan transactions.
